The terms on which a society, its committee and its residents use Zwangu. Written to be read once by a committee and understood, rather than skimmed and accepted.
Zwangu is operated by Kuery Technologies Pvt. Ltd., a company incorporated in India. In these terms, "we" and "us" mean Kuery; "Zwangu" means the website and the apps.
The customer is the society, not an individual — a co-operative housing society, RWA, AOA or condominium association, acting through whoever its bye-laws authorise, usually under a committee resolution. An individual committee member signing up is doing so for the society, and confirms they are authorised to.
Residents, guards and other users get access because their society granted it. These terms apply to them for their own use of the app, but their account, and the data in it, belongs to the society.
Alongside these terms, a society signs a service and processing agreement. It names the purposes, the retention periods, the sub-processors and the deletion terms. Where that agreement differs from this page for your society, the agreement governs. Read it before you sign it, and take it to your advocate or CA.
The society owns its data. Members, ledger, vouchers, attachments, gate logs — all of it. Nothing in these terms transfers any ownership of it to us, and a full export is in the product from day one rather than available on request, in XLSX, PDF and Tally-readable formats.
We own Zwangu. The software, the interface, the brand and the documentation stay ours. You get a non-exclusive, non-transferable right to use them for your society while your agreement is in force. You may not resell Zwangu, rent it out, reverse-engineer it or copy the interface into another product.
If you send us feedback or a feature request, we may act on it without owing you anything for it. That is not a claim on your data — only on the idea.
We may suspend access where the service is being attacked or used unlawfully, or where continuing would put other societies at risk. Where we can tell you first, we will.
Either side may end the agreement on written notice as set out in it. On termination the society keeps full export access, and we delete your data within 30 days and confirm it in writing. Where a law requires either side to retain something, that retention survives and we will tell you what it covers.
We work to keep Zwangu available and correct, and we publish what we actually do rather than a number we cannot defend. But no software is faultless, and some things are outside our control — a network outage, a payment partner's downtime, an act of government.
Zwangu is provided on an "as is" basis beyond the undertakings written above and in your agreement. To the extent Indian law allows, we are not liable for indirect or consequential loss, or for loss of profit, goodwill or anticipated savings; and our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence.
Zwangu keeps your books. It does not replace your auditor, your advocate or your committee's judgement, and using it is not by itself compliance with the DPDP Act, co-operative law or anything else. Be wary of any vendor who tells you otherwise.
These terms are governed by the laws of India. The courts at the seat of Kuery Technologies Pvt. Ltd.'s registered office have exclusive jurisdiction, save that either side may seek urgent injunctive relief wherever it is needed.
We may update these terms. Where a change materially affects a society's rights we will give notice through the app and by email to the committee before it takes effect, and date the change on this page. Continuing to use Zwangu after that date means the updated terms apply.
Everything reaches us at contact@kuery.in — these terms, a data question, or a grievance. Put the subject in the subject line and it goes to the right desk. A telephone and WhatsApp channel is being published shortly. Our registered office address is on the about page.
This page is a summary of the terms on which we do business, in plain language. It is not legal advice. The agreement your society signs is the operative document, and it is meant to be read by your advocate or CA before signature.
